Zoning Ordinance
Skagit County uses its Zoning Ordinance to control growth and development in its wildland areas. Enacted in 1992, the pertinent section of the Zoning Ordinance restricts construction of residential and commercial buildings outside of rural fire protection district areas.
Section 14.04.190 of the Zoning Ordinance specifies that Building Permits for residential and commercial structures may not be issued outside of Rural Fire Protection District boundaries, except under certain circumstances. This ordinance effectively controls urban growth and provides for vegetation management when building does occur.
Exceptions
The exceptions which allow for single family or accessory building development outside of the fire districts are:
1. The lot was a legal lot of record prior to the adoption of the ordinance on June 11, 1990.
2. Approved non-combustible roofing materials must be used.
3. Slash abatement within 200 feet of any portion of the exterior of the structure, or to the maximum extent possible.
4. A safety zone cleared of flammable vegetation 30 feet from any portion of the exterior of the structure on level ground and 100 feet downhill on sloped ground.
5. Building sprinklers installed per NFPA 13D.
When an individual applies for a variance or a building permit outside of the Fire Districts, the Fire Marshal works with him on a case by case basis to determine the feasibility of the project. When development does occur it takes into account the need for firesafe construction and landscaping. The Fire Marshall has the opportunity to educate each homeowner regarding firesafe development before the house is built.
